The New Year seems great for women pensioners as it comes with an amendment in the law for female pensioners.
Women can now nominate their children for a pension over their husband in marital discord cases  the center on Tuesday.
What is in the Amendment?
The Central Civil Services (Pension) Rules, 2021, Rule 50, permit the payment of a family pension if a government employee or retired government employee passes away.
When a spouse of a deceased government employee or pensioner survives, the spouse receives the family pension first. It is only when the spouse of the deceased government employee or pensioner loses eligibility for a family pension or passes away that other family members can apply for a family pension in turn.
“The amendment permits the distribution of a female government servant’s family pension to a qualifying child ahead of her spouse in all situations where the woman has filed for divorce, a petition under the Domestic Violence Protection Act, or a case under the Indian Penal Code,” DoPPW (Department of Pension and Pensioners’ Welfare) Secretary V Srinivas told PTI.
He also said that the amendment is progressive and empowers women employees in family pension cases.
The DoPPW reported that it had received numerous referrals from ministries and departments asking for guidance on whether a female employee or pensioner could allow her eligible child or children for a family pension instead of her spouse if marital discord resulted in the filing of divorce papers in a court of law.
According to the order, a female employee may request in writing to the concerned head of the office that in the event of her death “during the pendency of any of the aforesaid proceedings, family pensions may be granted to her eligible child /children in precedence to her spouse”, the statement said.
Female employees must be pleased with this gift as it makes life easier for them and those who are undergoing divorce, this amendment does them a Favour.
